Housing Privacy Notice

What we need and why

The Council (“we”) is the ‘Data Controller’ of the personal data you provide to us. We collect personal data about you which we need to allow us to process your application for housing on our Common Housing Register (CHR), meet our legal responsibilities under housing and homeless legislation, and to carry out housing services.

The personal information collected includes:

  • Your name
  • Date and place of birth
  • Address (current and previous)
  • Mobile and/or landline telephone number
  • Email address
  • Gender
  • Ethnic origin
  • Residency status
  • National Insurance number
  • Health/Medical information
  • Criminal convictions

We may ask you for financial information if you have indicated on your application that you may have difficulty paying your bills or if you are participating in our rent deposit guarantee or private rented guarantor scheme.

We will ask you for information about your carer or relatives if it is required to support your application for housing in Angus.

We may ask you for information about any physical or mental health conditions or support needs to ensure we have an understanding of your housing needs and to give you appropriate information and advice on your suitable housing options.

We may contact any social work or health professionals as considered necessary to ensure that a full assessment of any extra housing needs on medical, care or support grounds can be made.

We will ask you about any criminal convictions you have to meet legal and public protection obligations we have when processing your application.

Who we share information with

Where necessary your information will be shared with:

  • Housing Support Agencies
  • Council appointed contractors
  • Scottish Courts
  • Sheriff Officers
  • Regulatory bodies
  • NHS
  • Scottish Prison Services
  • Registered Social Housing Landlords
  • Other Council Services, as appropriate

When you sign your tenancy agreement for your property we will share your name and address with the relevant power supplier to enable them to transfer the billing of future utilities to you.

What is the legal basis for using/sharing your information?

The legal basis is it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller as per Article 6(1) (e) of the UK GDPR. This is because we have a duty under the Housing (Scotland) Acts 1987 and 2001, the Homelessness etc. (Scotland) Act 2003 and the Antisocial Behaviour etc. (Scotland) Act 2004 to provide housing services.

Special category data and criminal convictions

For some activities, we also need to process more sensitive personal information about you known as special category data, for example health information and criminal convictions data. Processing is necessary for reasons of substantial public interest as set out in Article 9(2) (g) of the UK GDPR and meets a condition in Part 2 of Schedule 1 of the Data Protection Act 2018.

What we do with it

The information will be used to manage all housing related matters. We will collect personal data in order to oversee the provision of housing advice and services.

We maintain data protection controls in line with the General Data Protection Regulation, other data protection legislation and its own Information Security Policy to ensure the effective and secure processing of your personal information.

How long we keep it

If you enter into a tenancy with the council, we keep your application information for the duration of your tenancy and for five years thereafter, after which time it will be destroyed.

If your application for housing is cancelled before entering into a tenancy with the council or our partners, we keep your application information and any associated supporting information for six months thereafter, after which time it will be destroyed.

If you participate in our rent deposit guarantee or private rented guarantor scheme, we will retain your information for the duration of your tenancy and for one year thereafter.
