Wherever Angus Council processes personal data, we need to make sure we have a legal basis for doing so in data protection law. The Council is the Data Controller for the following personal data which we require for the delivery of our services.
For waste collection purposes we may collect any of the following depending on the service you require; your name, address, telephone number, email address, number of children (and age groups) in your household, number of adults in your household, statement of medical condition (not requiring details) and vehicle details.
Your name, address and vehicle registration number are required to verify your identity upon visiting recycling centres. If you have booked an appointment we also require your phone number and email address in case we need to contact you due to short notice changes, such as a site closure.
Within our recycling centres we also operate CCTV and body-worn cameras and therefore imagery and audio may be collected.
The Council’s legal basis for processing personal data in relation to domestic waste and recycling is 6(1)(c) and 6(1)(e) GDPR, and Article 6(1)(b) GDPR for commercial waste purposes. Our basis for the processing and retention of Waste Transfer Notices for business or commercial waste is Article 6(1)(c) GDPR. This is because these matters are a legal obligation and public task under the Environmental Protection Act 1990 and the Waste (Scotland) Regulations 2012. How we collect your information
Your personal information may be collected on either a paper or online form, by telephone, email or by a member of our staff.
Your personal information is held on servers within the EEA and processed by our staff in the UK. No third parties have access to your personal data unless permitted by law.
The council maintains data protection controls in line with the General Data Protection Regulation, other data protection legislation and its own Information Security Policy to ensure the effective and secure processing of your personal information.
What we do with your personal information
We use personal information so that we can provide the following services: household waste collection (including assisted collection and loan bin services), waste disposal at recycling centres, commercial waste collection, special uplifts and "adopt a street" provisions. We may use your details to ask for confirmation of the nature of waste that has been delivered. Your information is also analysed internally to help us improve our services.
How long we keep it
We only keep your personal information for the minimum period amount of time necessary. Sometimes this time period is set out in law, but in most cases it is based on business need. As we are providing you with a waste service we will keep your information generally for the duration of the service provision or for as long as required for verification purposes, for example where we require confirmation of the nature of waste delivered.
If you have made a payment for a service or received a grant from us then we are required under UK tax law to keep your basic personal data (name, address, contact details) for a minimum of six years after which time it will be destroyed. CCTV and body-worn camera footage will be retained for 30 days unless required for evidentiary purposes.
