Getting married in Scotland

Any two people, regardless of where they live, can marry in Scotland, providing:

  • they are at least 16 years of age on the day of marriage
  • they are unmarried
  • they are capable of understanding the nature of a marriage ceremony and of consenting to marriage
  • the marriage would be valid in any foreign country to which either person belongs
  • they are not related in a way which would prevent their marrying

In Scotland you can be married by either a civil ceremony or a religious/belief ceremony.

Civil ceremony

This may only be solemnised by an authorised registrar or assistant registrar who has been specifically appointed by the Registrar General.

Religious/belief ceremony

This ceremony, whether Christian or non-Christian, may be solemnised only by a minister, clergyman, pastor, priest , humanist, or other person entitled to do so under the Marriage (Scotland) Act 1977.


Witnesses

Two witnesses must be present at your marriage/civil partnership ceremony.

Anyone can be a witness as long as they are aged 16 or over and capable of fully understanding the proceedings.
